TERMS AND CONDITIONS
The following Terms and Conditions set out the rights, restrictions, and obligations as they apply to the short-term rental of 18 Anita Drive in St Clements (the “Property”), being operated by 2306654 Ontario Inc., operating as Anita Retreat (the “Host”).
By finalizing the short-term rental booking, the individual renting the Property (the “Renter”) confirms review and acceptance of these Terms and Conditions as a pre-condition of their booking:
BOOKING AND PAYMENT
- The Renter has agreed to a short-term vacation rental the Property for the dates set out in the rental booking (the “booking dates”). Unless otherwise confirmed in writing by the Host, check-in at the Property is as follows: Mon-Thurs 10:00am on the first day of the booking and check-out is at 4:00pm on the last day of the booking. Thurs-Sun 4pm on the first day of the booking and check-out is at 4:00pm on the last day of the booking. Weekly Mon-Sun 3pm on first day of booking and 4pm on last day of booking.
- The Renter’s booking of the Property must be for a minimum of three consecutive nights (the “minimum stay”), except for during holiday and peak-rental seasons, in which case the Host reserves the right to mandate a longer minimum stay. In the event the booking is for less than the minimum stay, the Host reserves the right to charge an amount equal to the then-current minimum stay rental fee.
- The Renter’s booking will not be confirmed until the Renter has paid the deposit to the Host equal to five hundred ($300.00) (the “deposit”) and acknowledged review and acceptance of these Terms and Conditions. The deposit shall be non-refundable and shall be paid by way of cash, electronic transfer or, or by credit card (3% processing fee applies to any credit card payment made)
- The balance of the daily rental fee charged for the rental shall be paid not less than one 14 Days prior to the booking, and shall be paid by way of cash, electronic transfer to or by credit card (3% processing fee applies to any credit card payment made) (the “rental fee”).
A security hold of $500 may be applied to credit card which is fully refundable on checkout providing no damage has occurred to the property. (see paragraphs 8,10,12,13 for examples of damage)
- The rental fee is subject to change without notice, and the Host reserves the right to increase the rental fee during holiday or peak-rental seasons.
- The Renter shall not provide any false or misleading information to the Host in the booking process and shall disclose the names of all guests and invitees to the Property. In the event the Renter has secured booking of the Property under false or misleading pretenses, the Host reserves the right to cancel the booking, refuse check-in, and to retain all deposit and rental fee made by the Renter.
- The Renter is responsible for the conduct of all guests and invitees at the Property during their booking and assumes all liability associated therewith. The Renter shall release, indemnify, and save harmless the Host, including the directors, officers, employees, and shareholders thereof, from and against any and all liability, including damage to person or property, suffered in connection with their rental of the Property, including any such liability associated with or damages suffered by their guests or invitees.
RULES AND RESTRICTIONS ON THE PROPERTY
- The Property shall be maintained by the Renter and their guests and invitees in the same material condition as provided by the Host. The Renter shall be obligated to restore the Property to the substantive condition as at the commencement of the booking at check-in. In the event the Renter fails to fulfill these obligations, or, in the event the condition of the Property is deemed unsatisfactory by the Host upon check-out, the Renter shall be charged the cost of third-party cleaning services to restore the Property plus a fifteen percent (15%) administration fee by the Host.
- The maximum occupancy of the Property is twelve (14) persons. The Property shall not be used for parties or gatherings open to the general public, and the Renter and their guests and invitees shall not create any noise or disturbance. The Host shall be entitled to attend the Property during the booking to ensure compliance with this provision and shall be entitled to terminate the booking and retain all deposit and rental fees paid in the event the Renter refuses compliance herewith.
- The Property has a well and septic system independent of municipal services. This system is very effective, however, it is subject to blockage if materials other than toilet paper are flushed in the toilets or drains. In the event feminine hygiene products or other refuse is flushed in the toilets or drains, the Renter’s credit card shall be charged the cost of third-party repair plus a fifteen percent (15%) administration fee by the Host.
- The Host will furnish the Property with fresh linens and towels prior to check-in, however, there is no daily maid, cleaning, or laundry service available at the Property.
- Furnishings supplied to the Property are subject to change without notice. Furniture, bedding, kitchen equipment, utensils, and any other personal property supplied to the Property must not be removed from the Property. Loss of any items within the Property or damage to the Property or furnishings in excess of normal wear and tear will be charged to Renters credit card at the full replacement cost of same. If any appliance or items on the Property should break or suffer damage, the Renter shall notify the Host immediately.
- There is no smoking permitted on the Property, including in the residence and on the grassed areas. In the event there is evidence of smoking or damage to the Property, the Renters credit card shall be charged the cost of third-party remediation services to the Property plus a fifteen percent (15%) administration fee by the Host.
- Pets are not permitted on the Property.
- The Renter shall not permit vehicles to be parked on the grassed areas at the Property. There is ample parking available on the driveway and street. (Street parking may not be available during winter months (Nov. 15-Apr. 15)
- The Renter shall adhere to all guidance, instruction, and additional rules provided by the Host in association with Property and the utilities, appliances, and facilities thereto as provided in writing.
- In the event the Renter or their guests or invitees fail to abide by these Terms and Conditions, or, in the event the Renter or their guests and invitees are engaged in conduct not expressly prohibited herein but that is likely, in the opinion of the Host, to result in damage to person or property, the Host shall be entitled to terminate the booking and retain all deposit and rental fees paid by the Renter.
REFUND POLICY
- No refund shall be given for cancellation due to rain, snow, wind, or other inclement weather. Except as expressly outlined herein, the Host shall be entitled to retain the deposit paid by the Renter in the event of cancellation or termination of the booking.
- In no event shall the Host be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, pandemic, nuclear or natural catastrophes or acts of god, and interruptions, loss or malfunctions of utilities, communications or computer services (a “force majeure”), it being expressly understood that the Host shall use reasonable efforts which are consistent with accepted industry practices to facilitate and enable the use of the facilities contemplated herein. The Host reserves the right to determine appropriate refund for loss of services to the Property due to force majeure on a case-by-case basis.
- Notwithstanding anything else herein, in the event the Renter’s booking of the Property contemplated under the booking agreement is not permitted to occur pursuant to an order issued by or at the direction of the federal or provincial governments and/or public health authorities in response to a health pandemic or force majeure as defined herein, the Host shall be permitted to propose to the Renter a list of alternative dates, if available, in the next six (6) calendar months from the booking date and the Renter shall have the option to either accept one of the alternative dates proposed or to terminate their booking and be refunded any deposit paid hereunder.
- Provided the Renter’s booking of the Property is permitted to occur in substantial compliance and is not expressly prohibited by order issued by or at the direction of the federal or provincial governments and/or public health authorities, the Renter shall remain obligated to abide by these Terms and Conditions while undertaking and agreeing to make necessary modification to their booking to comply with the direction of the aforementioned authority, the cost and responsibility of compliance with and enforcement of the requirements imposed by said authority being borne solely by the Renter.
GENERAL PROVISIONS
- The Renter’s booking of the Property shall constitute the rental of an accommodation provided to the vacationing public and shall be expressly excluded and exempted from the purview of the Residential Tenancies Act.
- If any section or portion of these Terms and Conditions is held to be invalid, the remainder of these Terms and Conditions shall remain in force and effect.
- The Host agrees not to share any personal information disclosed by the Renter required under the booking with any third parties, except as expressly disclosed in the booking process or under these Terms and Conditions or with the express consent of the Renter.
- The Host reserves the right to request changes to these Terms and Conditions or the booking arrangement up to thirty (30) days prior to the booking dates. In the event the Renter refuses such changes, the Host shall return forthwith any deposit or other funds advanced and the booking shall be terminated.
